Batman's been written in that "darker" way, and they could have done it in this movie, or at least made the ambiguity stronger. When your hero isn't good, and doesn't necessarily intend to be good, you have to step a bit more carefully to avoid being just vapid and Hot-Topic 3dgy. There's a big difference between Nietzsche and a greasy 15-year-old who's read Nietzsche.
So if a character with audience sympathy does something bad or questionable, someone within the story itself (even the narrator, in fiction) has to broach the issue.
The other problem is that when you do pay attention to issues like this, half the critics get mad and say you're not doing a "real" action movie. And sometimes you really do bog down the picture with angsting and philosophising. Action movies are hard to balance (see Hulk, The).
