Batman, from what I understand, has always been something of a rogue element amongst his fellow superheroes; he's always the one who operates in secrecy and is more violent towards villains and all sorts of dark and edgy stuff. So it makes since that the movie would show him doing things that are a bit ethically dodgy.

As for how he dealt with Ducard...hmm. I can't decide whether or not it would be better to kill such a deadly, committed villain to make sure he never harms anyone else, or to try and keep him alive so he can face trial and imprisonment.
